The Estonian Supreme Court hands down an important decision regarding challenges to visa decisions

The Estonian Supreme Court recently rules certain provisions in the Aliens Act unconstitutional (link to the decision: https://www.riigikohus.ee/et/lahendid/?asjaNr=5-24-28/22 ).
The Aliens Act currently states that if a person gets a negative decision regarding their visa decision when they have applied for the visa while physically being in Estonia, they have no right to turn to the administrative court to challenge the decision.
According the the Supreme Court such a right has to exist for an individual to protect their subjective rights. As that part of the Aliens Act is deemed unconstitutional it needs to be changed and such a right of visa applicants has to be respected even before the changes are made.
